Xbox Live 1 Month Free?

I just bought a xbox elite off ebay and my friends tolded me that the One free Month trial of xbox live gold has been scraped. I don't know if their right or not so i was woundering if anybody could help me.=\

I believe brand new ones get a month free. If it is used in any way I would bet the free month is gone.
